VILLAGE OF CHURCHVILLE

NOTICE OF ADOPTION

 

WHEREAS notice of public hearing was duly given and said hearing held in the Village Hall, 23 E Buffalo St, Churchville, NY on the 9th day of April 2018 at 7:15 p.m. to consider the adoption of

 

Local Law #1-2018

A LOCAL LAW TO ESTABLISH A MORATORIUM ON

THE ACCEPTANCE OF APPLICATIONS FOR AMENDMENTS TO THE ZONING CODE AND/OR MAP OF THE VILLAGE OF CHURCHVILLE, AND ON ACCEPTANCE OF APPLICATIONS FOR BUILDING PERMITS, SUBDIVISION APPROVALS, OR PRELIMINARY OR FINAL SITE PLAN APPROVALS, IN THE BUSINESS USE, INDUSTRIAL USE, HIGHWAY COMMERCIAL, LIGHT INDUSTRIAL PARK (A/K/A LIGHT INDUSTRIAL DISTRICT), AND VILLAGE CENTER DISTRICTS

 

The Local Law may be summarized as follows:

 

Section 1 States the title of the Local Law

 

Section 2 gives the background information and rationale for imposing a moratorium

 

Section 3 imposes a Moratorium, for a period of 6 months, in the following zones/districts of the Village,

A. Business Use

B. Industrial Use

C. Highway Commercial

D. Light Industrial Park (a/k/a Light Industrial District)

E. Village Center District

 

Section 3 also defines the Moratorium to apply to the following actions within these aforementioned zones:

A. Acceptance of applications for amendments to the Zoning Code and/or Map of the Village of Churchville

B. Acceptance of Applications for Building Permits, Subdivision Approvals or Preliminary or Final Site Plan Approvals

 

Section 3 also provides for the option to extend the moratorium for one additional six month period by resolution of the Village Board upon a finding on the record of the need for such extension.

 

Section 4 lists activities and matters which would be exceptions from the Moratorium.

 

Section 5 recites the classification under SEQRA as a Type II action requiring no further review under SEQRA

 

Section 6, 7, 8 and 9 contain validity, severability and effective date provisions.

 

A complete copy of the proposed Local Law is on file in the Village Clerk’s Office, where it may be examined during regular business hours.

 

 

NOW THEREFORE PLEASE TAKE NOTICE that after due consideration and deliberation, the Board of Trustees duly adopted said local law.

 

A complete copy of both of the local law and the zoning map (dated and signed by the Village Clerk on October 23, 2017) is available for inspection at the Village of Churchville Office, 23 E. Buffalo St., Churchville NY 14428 during regular business hours.
